Welcome to Giggenie.io (“we,” “our,” or “the Platform”), a digital marketplace that connects service providers (“Sellers”) with buyers (“Buyers”). By accessing or using our website and services, you agree to be bound by these Terms of Service (“Terms”), as well as our Privacy Policy and any other applicable policies. If you do not agree with these Terms, you must not use our services.

These Terms apply to all users of the Platform, including both Sellers and Buyers, regardless of whether they are registered or not. The Platform is operated in accordance with the applicable laws of Croatia.

• Buyer: An individual or entity purchasing services on Giggenie.io.
• Gig: A service offered by a Seller for purchase on the Platform.
• Order: A binding agreement between a Buyer and Seller for a specific service on the Platform.

3. Eligibility

By using Giggenie.io, you affirm that you are at least 18 years of age or have the legal authority to enter into binding contracts in your jurisdiction. You must comply with all local laws and regulations applicable to your use of the Platform, including Croatian laws, consumer protection laws, and digital market regulations.

4. Account Registration

To access certain features of the Platform, you must create an account. When registering, you agree to:

• Keep your account information up to date.
• Maintain the confidentiality of your account credentials.
• Notify Giggenie.io of any unauthorized use of your account.

5. Seller Obligations

As a Seller, you agree to:

• Provide accurate descriptions and clear pricing for your services (“Gigs”).
• Deliver services as described in your Gig within the agreed timeframe.
• Ensure that all services provided comply with Croatian laws and do not infringe on any intellectual property rights or other rights of third parties.
• Communicate professionally and promptly with Buyers.
• Resolve disputes with Buyers in good faith and per the Platform’s policies.

You are responsible for paying all applicable taxes on your earnings in accordance with Croatian tax laws.

6. Buyer Obligations

As a Buyer, you agree to:

• Provide clear and accurate instructions for the Seller to fulfill your order.
• Pay for services in full upon placing an order, using the available payment methods.
• Not engage in fraudulent activity or abuse the dispute resolution process.
• Communicate professionally and promptly with Sellers.
• Leave feedback in good faith based on your experience with the Seller.

7. Payments and Fees

7.1 Payment Processing

Giggenie.io processes payments via trusted third-party payment gateways. Payment for services is made in advance, and funds will be held in escrow until the order is completed by the Seller. Once the order is completed, the funds are released to the Seller.

7.2 Platform Fees

Giggenie.io charges a fee for using the Platform. This fee is a percentage of the total transaction amount and is deducted from the payment to the Seller. The exact fee structure will be displayed on the Platform and may be updated from time to time.

7.3 Currency

7.4 Refunds and Cancellations

If the dispute remains unresolved, Croatian law shall apply, and the dispute may be resolved through litigation in the competent courts in Croatia.

9. Intellectual Property

9.1 Ownership

By using Giggenie.io, you acknowledge and agree that:

• All content on the Platform, including logos, designs, text, graphics, and software, is the property of Giggenie.io and is protected by intellectual property laws.
• Sellers retain ownership of their Gigs and any content they upload, but they grant Giggenie.io a non-exclusive, royalty-free, worldwide license to use, display, and distribute the content within the Platform for the purposes of promoting and providing services to Buyers.

9.2 Prohibited Content

Sellers are prohibited from uploading any content that:

• Infringes on the intellectual property rights of others.
• Contains malware, viruses, or other harmful software.
• Violates any applicable laws, including but not limited to, Croatian laws and EU regulations.
• Promotes illegal activities, hate speech, or discrimination.

Giggenie.io reserves the right to remove or disable access to any content that violates these rules.

10. Privacy and Data Protection

Giggenie.io is committed to protecting your privacy. By using the Platform, you agree to our Privacy Policy, which explains how we collect, use, and protect your personal data in accordance with applicable laws, including the General Data Protection Regulation (GDPR).

11. Limitation of Liability

Giggenie.io does not guarantee the quality or timeliness of the services provided by Sellers. The Platform is provided “as is,” and we make no representations or warranties, express or implied, regarding the quality, reliability, or legality of any services offered by Sellers.

To the fullest extent permitted by law, Giggenie.io shall not be liable for any indirect, incidental, special, or consequential damages arising from the use or inability to use the Platform, even if we have been advised of the possibility of such damages.

12. Termination and Suspension

Giggenie.io may suspend or terminate your account at any time, with or without cause, including but not limited to:

• Violating these Terms or any applicable laws.
• Engaging in fraudulent activity.
• Providing misleading or false information.

Upon termination, your access to the Platform will be revoked, and any pending orders will be handled in accordance with our policies.
